In fact, the issue of fending off the Court of Cassation about the conflict term is one of the important subjects, although it doesn't take that attention from the researchers whereas it is seen as a simple subject that does not support a legal research, it traits briefly unless it's rich of results, beside this research aims to assess the situation in Syria, Lebanon, Jordan, Egypt and some countries of the Gulf Cooperation Council, also in French judiciary on occasion.

The study compared everything that was possible, but the difficulty in this comparative study is that it is impossible to have two courts of discrimination that are identical in opinion, conditioning and causation.
